**Swift Skills Terms of Service**

Welcome to Swift Skills! These Terms of Service govern your use of our tutoring services, website, and related applications (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

**1. Tutoring Services**

1.1 **Eligibility**: Our Services are available to individuals who are at least 18 years old or minors who have obtained parental or legal guardian consent to use our Services.

1.2 **Registration**: To access certain features of our Services, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

1.3 **Tutoring Sessions**: We provide tutoring services tailored to your needs and requirements. The scheduling of sessions, content covered, and any additional materials are agreed upon between you and your tutor.

1.4 **Cancellation Policy**: You may cancel or reschedule a tutoring session up to 24 hours before the scheduled start time without incurring any fees. Cancellations made less than 24 hours before the scheduled start time may result in a cancellation fee, as outlined in our cancellation policy.

**2. Payment**

2.1 **Fees**: Fees for tutoring services are communicated to you prior to scheduling sessions and are based on the duration and type of tutoring requested.

2.2 **Payment**: Payment for tutoring services is due in advance or as otherwise agreed upon between you and Swift Skills.

2.3 **Refunds**: Refunds may be issued according to our refund policy, which is available upon request.

2.4 **Discounts**: Discounts and negotiations are available upon contact. Failure to abide by discussed conditions can result in no service for no refund. Codes given through this are not to be shared without permission from merchant.

**3. Code of Conduct**

3.1 **Respect**: We expect all users of our Services to treat tutors and fellow users with respect and professionalism at all times.

3.2 **Communication**: Clear and respectful communication is essential. Any form of harassment, discrimination, or inappropriate behavior will not be tolerated.

3.3 **Intellectual Property**: All materials provided during tutoring sessions are for personal use only and may not be reproduced, distributed, or used for any other purpose without the express consent of Swift Skills and/or the respective tutor.

**4. Privacy**

4.1 **Data Collection**: We collect and process personal data in accordance with our Privacy Policy. By using our Services, you consent to such collection and processing.

4.2 **Confidentiality**: We respect the confidentiality of our users and tutors. Any information shared during tutoring sessions is confidential unless otherwise agreed upon by both parties.

**5. Limitation of Liability**

5.1 **Disclaimer**: Swift Skills and its tutors provide tutoring services "as is" and without any warranty or guarantee. We do not guarantee specific results from tutoring sessions.

5.2 **Liability**: In no event shall Swift Skills or its tutors be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our Services.

**6. Other**

6.1 **Non-Solicitation Agreement**: Previous clients must be aware of our non-solicitation agreement, which prohibits communication for 13 months after the final session under a different company. Swift Skills waives liability in the event of accidental communication in violation of this agreement.

6.2 **Independence of Tutors**: Swift Skills is not responsible for matching or honoring services provided by fellow tutors on this website. Each tutor operates independently, and clients should be aware of the individual limitations, responsibilities, and availability of each tutor.

These Terms of Service constitute the entire agreement between you and Swift Skills regarding your use of our Services and supersede any prior agreements between you and Swift Skills. If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
